Equipment Warranty Policy for SOFTCOM

Warranty for Equipment Provided By Softcom. Softcom will sell to you, and you will purchase from Softcom, as applicable, a subscriber unit and related cabling when you order Internet Access Service (the “Equipment”). Softcom warrants to you that all Equipment purchased from Softcom will be substantially free from material defects in material and workmanship, under normal use and in compliance with Softcom’s instructions, for a period of one (1) year from the date you receive the Equipment for City-Wide Wi-Fi and Fixed Wireless Equipment; and for two (2) years on DSL Equipment (“Purchase Limited Warranty”). All or part of the Equipment may be reconditioned or refurbished, but all Equipment will be warranted as provided in these Terms. This Purchase Limited Warranty excludes any damage resulting from abuse, misuse, neglect, theft, vandalism, fire, unusual physical or electrical stress, water, extremes of temperature, other peril or act of God, your failure to comply with any Equipment instructions provided by the equipment manufacturer or Softcom, actual or attempted alteration, reverse engineering, unauthorized access, or additions to the Equipment not approved by Softcom, all as determined in the sole discretion of Softcom. Softcom will have the sole discretion to determine whether to repair or replace any Equipment. Repair or replacement of the Equipment is Softcom’s only responsibility, and your exclusive remedy, for breach of any warranty regarding the Equipment. This Purchase Limited Warranty is in lieu of all other warranties, express or implied, including but not limited to any implied warranties of merchantability or fitness for a particular purpose, and is further subject to the exclusions and limitations in Section 4 of the Terms of Service. Unless you purchase the Extended Warranty, any repair, upgrade, or replacement of the Equipment following the expiration of the Purchase Limited Warranty term, resulting from defects in the Equipment or from any other cause, will be your responsibility. Termination of services with Softcom for any reason will end any Purchase Limited Warranty from Softcom; the manufacturer will be exclusively responsible for the remainder of the warranty period from the termination date.

Equipment Replacement Plan. Softcom offers an Equipment Replacement Plan (“Extended Warranty”) to extend the limited warranty beyond the initial terms of one (1) or two (2) years. This Equipment Replacement Plan may be purchased only for a period of thirty (30) days after the expiration of the Purchase Limited Warranty. After the expiration of this period, you may not purchase the Extended Warranty. The Extended Warranty covers the Equipment that you purchase from Softcom while you remain a customer of Softcom. This Extended Warranty has the same exclusions as the Purchase Limited Warranty. It excludes any damage resulting from abuse, misuse, neglect, theft, vandalism, fire, unusual physical or electrical stress, water, extremes of temperature, other peril or act of God, your failure to comply with any Equipment instructions provided by the equipment manufacturer or Softcom, actual or attempted alteration, reverse engineering, unauthorized access, or additions to the Equipment not approved by Softcom, all as determined in the sole discretion of Softcom. Softcom will have the sole discretion to determine whether to repair or replace any Equipment. Repair or replacement of the Equipment is Softcom’s only responsibility, and your exclusive remedy, for breach of any warranty regarding the Equipment. This Extended Warranty is in lieu of all other warranties, express or implied, including but not limited to any implied warranties of merchantability or fitness for a particular purpose, and is further subject to the exclusions and limitations in Section 4 of the Terms of Service. Termination of services with Softcom for any reason will end any Extended Warranty coverage that you purchase effective the date of your account closure. Failure to pay any fees relating to the Extended Warranty will render your coverage under the plan null and void. Accounts not in good standing will not be eligible to submit claims on the Extended Warranty.

The cost for the Extended Warranty is as follows:

$2.99 per month for DSL Equipment and wiring;
$3.99 per month for City-Wide Wi-Fi Access Equipment and wiring;
$4.99 per month for Fixed Wireless Equipment and wiring.
